Samantha Geimer, who the filmmaker is accused of having unlawful sex with when she was just 13, filed a petition at Los Angeles County district attorney's office on Monday (12Jan08) asking for the case to be dismissed.
Geimer, now 45, insists the renewed interest in the case will be traumatic for her as prosecutors will focus on details of the sexually explicit aspects of the assault.
And she accused the L.A. judicial system of "trying to distract attention" of their own mishandling of the original case by reciting the "lurid details" of the sex attack.
In the declaration, Geimer says, "If Polanski cannot stand before the court to make this request, I, as the victim, can and I, as the victim do.
"My views as a victim, my feelings as a victim, or my desires as a victim were never considered or even inquired into by the district attorney prior to the filing. It is clear to me that because the district attorney's office has been accused of wrongdoing, it has recited the lurid details of the case to distract attention from the wrongful conduct of the district attorney's office as well as the judge who was then assigned to the case."
And Geimer believes the case will bring harm to her and her family.
The legal document adds, "True as they may be, the continued publication of those details causes harm to me, my beloved husband, my three children and my mother."
The Oscar-winning auteur pleaded guilty to the charge before fleeing America and has lived the last three decades in exile.
Polanski's lawyers filed a motion earlier this month (Jan09) requesting officials to dismiss the 32-year-old sex case on the grounds of bias. The request was later denied.
