Milian alleges Poli Paul, who wrote the smash, assured her "there were no samples whatsoever" in Dip It Low, but the singer has since spent a fortune in legal costs, defending herself in a plagiarism lawsuit.
Thomas Turino, Larry Crook and Dan Dickey sued Milian, claiming a portion of her song was illegally lifted from their 1983 track La Sirena.
In legal documents filed in Los Angeles on Thursday (07Aug08) and obtained by TMZ.com - Milian claims Poli Paul looped a 12-second sample of La Sirena into Dip It Low after hearing the track in a record store.
Her lawyer, Ed McPherson, wants Paul and his associate, Spencer Cowlings Entertainment, to pay the $300,000 (GBP150,000) Milian has already spent defending herself in the case, and punitive damages.
