LIL WAYNE MAKES COURT APPEARANCE

LIL WAYNE stepped into a New York court on Tuesday (11Aug09) to challenge the use of DNA evidence in his ongoing gun-possession case.

The rapper appeared briefly at the Manhattan hearing, where his attorney fought the prosecution's attempts to connect the Lollipop hitmaker to the firearm.

Wayne - real name Dwayne Carter, Jr. - has pleaded not guilty to two second degree felony counts of criminal possession of a weapon after a police search of his tour bus during a 2007 stop in New York turned up a .40 calibre handgun.

Carter maintains the gun is registered to his manager Cortez Bryant, while the district attorney claims to have DNA results that link the star to the weapon.

But Carter's lawyer Stacey Richman believes court officials should carefully consider using the method in determining the star's fate, insisting the results can be misleading.

Richman tells MTV.com, "It's about whether or not we get a hearing to evaluate whether this type of DNA evidence is admissible. It's not accepted anywhere else in the country. Los Angeles just rejected it March 18th. It's problematic. People assume DNA (is accurate), but that's not the facts. And there's great concern.

"It's not just a Lil Wayne case, but all citizens. You don't want a rubber-stamp procedure that could potentially convict thousands of innocent people."

A judge is expected to rule on the next motion when the case returns to court next month (Sep09).
