German synth-pop pioneers KRAFTWERK have lost the latest round of their copyright battle against a rap producer who sampled two seconds of their METAL ON METAL track.
Kraftwerk at Coachella Music Festival 2008 - Day 2. Indio, California - 260408
A state court in Hamburg ruled that Moses Pelham had violated Kraftwerk's copyright by using the brief sample in his 1997 hit Nur Mir, but a national civil court has overturned the decision.
The civil officials have ruled the sample bears no resemblance to the original song, and therefore Pelham is within his rights.
Kraftwerk were in the process of suing the rap producer.
