SPEARS' DAD TELLS COURT OF PLAN TO RETURN 'HOME'

LATEST: BRITNEY SPEARS' father JAMIE stuck to the statement of his daughter's lawyer while testifying in her driving license trial on Thursday (16Oct08) - insisting she only stays in California to be close to her children.

The Toxic star's lawyer Michael Flanagan opened his argument against the driving without a license charge in Van Nuys, California, telling the jury that the star doesn't need a California state license - because of her complicated residency situation.

Spears, who was not present in court, was arrested and charged with failing to produce a valid license following a car crash last year (07).

She had a valid Louisiana state license, but not a California one.

And Jamie Spears, the singer's father and conservator of her estate, backed up Flanagan's defence, telling the court that there is a plan in motion for Spears to move back to her native Louisiana after she regains custody of her sons Jayden James and Sean Preston from their father Kevin Federline.

He said, "Her home is Louisiana. There's plans (to move Spears back) right now.

"We're here (in California) with her kids. We have visitation rights. We have to stay to augment those rights."

Elder Spears added that they would move back to Louisiana once they had rights to take her children out of the state of California, telling jurors, "We can travel with the kids (out of state) and spend time there."

Closing arguments are scheduled for Friday (17Oct08) morning.

If convicted, Spears faces a maximum six months in jail and a $1,000 (GBP540) fine.
