ALBRECHT KILLER TO ESCAPE CHARGES

LATEST: The man responsible for the death of rocker JEFFREY CARTER ALBRECHT will not face charges for the star's shooting, because he acted in self defence.

Edie Brickell + New Bohemians keyboardist Albrecht was shot by his girlfriend's Dallas, Texas, neighbour after he was mistaken for a burglar on Monday morning (03Sep07).

Albrecht, 34, was killed after the neighbour fired a shot through the front door at around 4am. The neighbour, whose identity has not been released, was not arrested.

Sergeant Larry Lewis confirmed the man would not face charges from the Dallas police force, although a grand jury will decide whether he is to be indicted.

Lewis says, "He yelled several verbal warnings, 'I'll shoot! I'll shoot!'. From what we gather, he fired near the top of the door, hoping he would scare the person away."

The shooting falls under the law of self defence, which allows a person to protect their property with a deadly force to "prevent the other's imminent commission... of criminal mischief during the nighttime."

Meanwhile, Albrecht's bandmate, Brandon Aly, has expressed his sorrow at the news of the death.

He says, "We are all completely devastated by the news of Carter's death, and obviously still quite in shock."
