SPECTOR'S EX-LAWYER AGAIN REFUSES TO TESTIFY
LATEST: PHIL SPECTOR's former lawyer has again been warned she will be held in contempt of court if she refuses to testify at the music producer's murder trial.
Los Angeles Superior Court Judge Larry Fidler told Sara Caplan he will have no choice but to hold her in contempt, although he is keen to avoid doing so.
In a hearing without the jury yesterday (14Jun07), Fidler deferred the issue until Monday (18Jun07).
Caplan has previously told the court she cannot testify about what she saw during a search of Spector's Alhambra, California home because she is covered by lawyer/client confidentiality.
Last month (May07), Caplan testified at an evidentiary hearing and claimed she saw forensic scientist Dr. Henry Lee remove a small white object during a search of the area where actress Lana Clarkson's body was found the day after she died.
Yesterday, an upset Caplan testified, "I don't know what I saw. I don't know that it was removed from the premises. I don't remember where it was."
Judge Fidler responded, "Ms. Caplan has clearly testified she observed Dr. Lee put something in a vial. It was white, hard, with rough edges. You cannot reconcile Dr. Lee's testimony and Ms. Caplan's testimony."
Spector is accused of the fatal shooting of Clarkson at his home in February 2003. He has pleaded not guilty and claims Clarkson committed suicide.
The trial continues.
