SMITH'S MOTHER WINS STAY IN BURIAL SAGA

LATEST: A Florida appeals court has granted ANNA NICOLE SMITH's estranged mother VIRGIE ARTHUR's request for a stay in the tragic celebrity's burial saga.

A state judge awarded Smith's remains to her daughter DANNIELYNN's legally-appointed guardian last week (ends23FEB07), and recommended the body be buried next to her son in the Bahamas, where Smith had been living since last summer (06).

The guardian, RICHARD MILSTEIN, decided to follow the judge's lead over the weekend, but now Arthur is fighting to change the ruling and take the remains back to Smith's native Texas.

The stay, granted yesterday (26FEB07), means Smith's body can't be moved from Florida until the appeals court hears the challenge from Arthur later today (27FEB07).

Arthur filed an emergency motion on Friday (23FEB07), asking the Florida authorities to reconsider their ruling, but they declined early yesterday, sending the desperate mother to the appeals court.

If the appeal is denied, Smith's funeral is expected to take place in the Bahamas later this week (ends02MAR07).
