Members of Oscar-winning rap group THREE 6 MAFIA have asked for the dismissal of a lawsuit filed by a man who claimed he was severely beaten at a concert when fans followed the lyrics of the song LET'S START A RIOT.

The group filed the motion last week (ends03SEPT06) in a Pittsburgh, Pennsylvania court, insisting there is no "genuine issue of material fact" to the complaint.
According to the motion, the lyrics are protected under the First Amendment of the US Constitution.
RAMONE WILLIAMS claimed in his lawsuit he was attacked during a show at a now-defunct Pittsburgh nightclub on 26 August 2003.
Williams, who was 19 at the time, said he got into the club and became uneasy when the song began.
Before it was over, Williams alleges he was thrown to the floor, hit with a chair, stomped on and kicked in the face. His injuries included a fractured jaw.
Williams won a default judgment from the club. The nightclub has since closed down and its former operators did not respond to the complaint.
The Memphis, Tennessee-based rappers won an Academy Award earlier this year (06) for their song IT'S HARD OUT HERE FOR A PIMP from the film HUSTLE + FLOW.

STAR TREK star LEONARD NIMOY insists he has no plans to return to acting and has long since turned his attention toward photography.

The star, who played MR SPOCK on the classic series, is satisfied with his long and varied acting career and is happy to leave that part of his life in the past.

"I had great challenges, worked with great people, and I got to do Broadway, so I had more than my share. I'm a very satisfied person.
"There were times in my life when I thought I might become a professional photographer...and now I have turned my energy toward fine art photography.

LATEST: OASIS may have grabbed the top spot for the world's greatest song under false pretences - because the chorus had to be sung by the producer when the GALLAGHER brothers failed to be up to the job.

The rockers' hit LIVE FOREVER, from their 1994 debut album DEFINITELY MAYBE, was voted the best track of all time by readers of British music magazine Q last month (AUG06).
But the main refrain had to be sung by producer OWEN MORRIS and the band's manager, when it transpired that NOEL and LIAM simply couldn't reach the notes.
He says, "Liam couldn't hit the high notes in the chorus.
"Noel wasn't the greatest singer back then, and so the line, 'You and me are gonna live forever' was actually sung by me and MARCUS RUSSELL, the band's manager."

LATEST: Crocodile Hunter STEVE IRWIN'S wife and two children rushed from a family holiday in Tasmania to their Queensland, Australia home last night (03AUG06) after learning Irwin had died in a freak stingray attack.
Irwin, a passionate conservationist, was killed when a stingray barb pierced his heart as he filmed footage for a new documentary on shallow reefs in north Queensland.
The footage of his fatal goring has been handed over to Queensland police, who are investigating the incident.
According to boat owner PETER WEST, "Something happened with this animal that made it rear and he was at the wrong position at the wrong time and if it hit him anywhere else, we would not be talking about a fatality."
Irwin's family was hiking near Cradle Mountain on the Australian island of Tasmania when he was killed just after 11 am on Monday (04SEPT06).
Wife TERRI, daughter BINDI SUE, 8, and son BOB, 2, flew out of Devonport, Tasmania to the Sunshine Coast on a chartered flight shortly after 5 pm.
Bindi clutched a blanket and stayed close to her mother, while her younger brother Bob skipped ahead as the family walked across the tarmac to their aircraft.
The news of Irwin's sudden death shocked the world and sparked a huge outpouring of grief, particularly in his homeland of Australia and in the US, where he had found fame and fortune as an adventurer and naturalist.

Late QUEEN frontman FREDDIE MERCURY has spoken out about his concerns for the modern world, according to celebrity medium PSYCHIC SALLY MORGAN.

Actor ZACH BRAFF is keen to settle down and have kids, because constantly buying baby gifts for pals has inspired him to consider a brood of his own.
The SCRUBS star, who split up with his former love MANDY MOORE in June (06) admits he is concerned about the number of marriages which fail, but he is determined to get it right - no matter how long it takes.
He tells Moviehole.net, "When you are 30 and buying baby carriages for your friends every other month, you can't help starting to examine your own desire to get married and have kids.

Disgraced British rocker GARY GLITTER is set to lose out on GBP100,000 ($180,000) per year in royalties, as his rock anthems have been banned in American football stadiums.
The glam rocker, real name PAUL FRANCIS GADD, made staggering amounts of cash thanks to his stirring singalong-style track ROCK AND ROLL PART 2, which was played as every league team ran onto the pitch and when a touchdown was scored.

The identity of the dentist who first introduced THE BEATLES to LSD has finally been revealed in a new book about the band.

An insider says, "The book is significant as drugs went on to have a big effect on the band.
"When you go for dinner with your dentist, you don't imagine a professional man would do something like that."
The brother of late screen star RICHARD BURTON has hit out at DAME ELIZABETH TAYLOR's biographer J RANDY TARBORELLI over claims the Welsh actor physically attacked Taylor.
GRAHAM JENKINS, 77, insists reports of Burton's violent drunken rages are "rubbish", even though TARBORELLI, who also wrote the biography of Taylor's pal MICHAEL JACKSON, supposedly consulted members of the NATIONAL VELVET star's "inner circle" for the book.
He fumes, "This is a load of rubbish and I question whether the author is compos mentis."
Tarborelli claims in the book Taylor halted her filming schedule after a particularly vicious attack at the hands of Burton: "She was unable to work on CLEOPATRA. Even heavy make-up was not enough when it came to the results of Burton's temper."
HARRY POTTER baddie LORD VOLDEMORT has been voted the best villain in children's books, according to a new poll.
The spooky nemesis of the popular boy wizard beat off competition from JRR TOLKIEN's evil THE LORD OF THE RINGS character SAURON in the survey, conducted online by BigBadRead.
Potter author JK ROWLING says, "I am thrilled and honoured beyond words that Lord Voldemort has been voted best villain in the BigBadRead poll. I am not sure how he would react to knowing that he had won a Muggles' (non-wizards) unpopularity poll.
"A mixture of pleasure that you recognised his power and menace, coupled with fury at your nerve at mentioning his real name, I think.
"His author, however, is absolutely delighted."

LATEST: British TV presenter RUSSELL BRAND has furiously denied any involvement in the alleged rape of a female guest at his Edinburgh Festival party last month (AUG06).
The comedian, alongside every other male guest at the party, faces a police interview and DNA test after a 20-year-old student reported she had been drugged and raped at the bash. The party, held at the comic's temporary Edinburgh residence, was thrown to celebrate the end of Brand's run of comedy gigs in the Scottish capital.
A spokesman for Brand says, "Russell Brand has no knowledge of, let alone any involvement in, the alleged assault of an Edinburgh woman.
"Mr Brand understands that a woman who, with a number of other people, visited his rented flat during the Edinburgh Fringe, has made a complaint to the police.
"As it was Mr Brand's flat, the police have asked to speak with him on his return from holiday and he is happy to assist the police with their inquiries."
A spokeswoman for Lothian and Borders police says, "A number of people have still to be traced and interviewed, and as such we cannot comment further."
The woman was advised to speak to police after being examined in hospital for forensic evidence when she awoke feeling uncomfortable and as if she had had sex. She believes her drink had been spiked at the party.

British movie star RACHEL WEISZ was stunned when her new movie THE FOUNTAIN was booed at its premiere at the Venice Film Festival yesterday (04SEP06).

The film, directed by her fiance DARREN ARONOFSKY, left the audience confused and disappointed - even though Weisz insists it is important to have something "different" on screen.
The $35 million (GBP18.3 million) flop was snubbed repeatedly by movie studios until Warner Brothers decided to back it. The story spans 1,000 years and stars HUGH JACKMAN as a 16th century Spanish explorer, 21st century scientist and 26th century astronaut searching for the Fountain of Youth.
Weisz, whose presence at the festival marked her first official public appearance since the birth of son HENRY CHANCE in May, says, "I think it's wonderful that this film is so different. I would love to work with Darren again."

Pop superstar CHRISTINA AGUILERA almost had a disastrous wedding day after her stylist forgot to bring her wedding veil.
The GENIE IN A BOTTLE star married marketing executive JORDAN BRATMAN in a California ceremony last year (05).
The singer admits she was furious when her stylist misplaced the essential wedding accessory and promptly fired her for the lapse, vowing never to work with her again.
Aguilera says, "At my wedding, I said 'Let's put the veil on' and it wasn't there. It was an oversight of my stylist, who I will never work with again.
"Thank God I had my mom's lace wedding piece so we made a makeshift veil."

The Canadian-born singer burst onto the music scene when she was 17 years old, and made a name for herself with her tomboy looks and edgy attitude.
She explains, "I used to come across as really tough, because that's who I was.
"When I was in high school I was a little s**t, hanging out with the guys, getting drunk, smoking, getting in fights, playing hockey.
"My band were all guys, so I was only around guys, but when I got older I started being more of a chick."
The 21-year-old appeared on the red carpet at the Cannes Film Festival in February (06), trading in her cargo pants for a floor-sweeping Giorgio Armani dress and champagne-blonde highlights, causing some critics to label her a "sell-out."
Lavigne hits back saying, "It's annoying. I dyed my hair a year and a half ago. But now everyone's like, 'Oh, she has this new look!' It wasn't overnight at all.
"I broke out on the scene looking like the 17-year-old that I was. And from then to now I look really different - but that's called growing up."
